These Terms of Service ("Terms") govern your access to and use of the website www.iron24pa.com, services, training programs, classes, memberships, and text message (SMS) communications operated by Iron 24 PT, a brand of GZP Fitness LLC d/b/a Pitcairn Performance ("Iron 24 PT," "we," "us," or "our").
By accessing our website, signing up for our services, providing your phone number, or otherwise interacting with us, you agree to be bound by these Terms. If you do not agree, do not use our services.
You must be at least 18 years old to create an account, purchase services, sign up for training programs, or consent to receive SMS messages from us. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
Minors aged 16-17 may participate in training programs only with explicit written parental or guardian consent. Children under 16 are not permitted to use our services or consent to SMS messages.

By enrolling in a training program or membership, you agree to the program-specific terms presented at the time of purchase, including price, duration, and any participation requirements.
Payment for memberships and programs is due upon enrollment unless otherwise agreed in writing. Recurring memberships may be billed monthly to the payment method on file. You authorize us (or our payment processor) to charge your selected payment method on a recurring basis until cancelled.
Sessions cancelled less than 24 hours in advance, or no-shows, may be charged at full session rate at our discretion.
Personal training, strength training, and physical exercise involve inherent risks including but not limited to injury, illness, and in rare cases, death. By participating in our programs, you acknowledge and agree:
A separate Liability Waiver and Health Disclosure may be required upon enrollment and supersedes this section where signed.
You agree to provide accurate, current, and complete information when registering, enrolling, or providing contact details. You are responsible for keeping your phone number, email, and payment information up to date. You may not use false identities or impersonate others.

All website content — text, graphics, logos, photographs, training program materials, videos, and software — is the property of Iron 24 PT, GZP Fitness LLC, or its licensors, and is protected by United States and international copyright and trademark law. You may not reproduce, distribute, modify, or create derivative works without our prior written consent, except for personal, non-commercial use.
Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
This Section 9 constitutes the complete terms governing our SMS messaging program. It is provided in compliance with CTIA Messaging Principles & Best Practices and 10DLC (A2P) carrier requirements.
Iron 24 PT SMS Program (operated by GZP Fitness LLC d/b/a Pitcairn Performance, brands: Iron 24 PT, Essential Strength, Essential Gym)
By providing your mobile phone number through any of our website forms, lead-generation ads, sign-up flows, in-person enrollment, or directly to our staff, you consent to receive recurring transactional and promotional SMS text messages from Iron 24 PT at the phone number provided.
Message frequency varies based on your engagement, membership status, and the programs you are enrolled in. You may receive between 1 and 10 messages per month under normal circumstances. Frequency may be higher during program launches, scheduling-intensive periods, or when responding to your inquiries.
Message and data rates may apply per your mobile carrier plan. Iron 24 PT does not charge a fee for sending or receiving text messages — any charges come from your wireless carrier. Check with your carrier for details on your messaging plan.
You may opt out of SMS communications at any time by replying STOP to any message we send you. Other accepted opt-out keywords include: UNSUBSCRIBE, CANCEL, END, QUIT.
After opting out, you will receive a one-time confirmation message: "You have been unsubscribed from Pitcairn Performance text messages. Reply START to resubscribe." You will not receive further marketing or transactional SMS unless you re-subscribe.
To resume receiving messages after opting out, reply START to any prior message thread or contact us directly.
For help with our SMS program, reply HELP to any message and you will receive: "Pitcairn Performance: For help, call 412-822-9030 or email info@iron24pa.com. Reply STOP to opt out. Msg & data rates may apply."
You may also contact us directly at any time using the information in Section 16.
Your consent to receive SMS messages from us is not required as a condition of purchasing any goods, services, or memberships from Iron 24 PT or any of our affiliated brands. You may opt out at any time without affecting your account, membership, scheduled sessions, or services you have purchased.
You must be at least 18 years old and the authorized user, account holder, or subscriber of the mobile phone number you provide. By providing your phone number, you represent that you meet these requirements.
We support all major United States wireless carriers, including but not limited to: AT&T, T-Mobile, Verizon Wireless, US Cellular, Boost Mobile, Cricket Wireless, Metro by T-Mobile, Sprint, Virgin Mobile, and most regional and prepaid carriers.
Carriers (including AT&T, T-Mobile, Verizon, and others) are not liable for delayed, undelivered, or misdirected messages. Service availability and message delivery are subject to mobile carrier coverage and may be affected by factors outside our control.
We do not sell, share, rent, or otherwise transfer your phone number, SMS consent data, or SMS-related opt-in information to any third party for marketing, promotional, or affiliate purposes. We share your phone number only with trusted operational service providers (such as Twilio, our SMS delivery platform) who are contractually bound to use the data solely to deliver our messages on our behalf.
Your SMS-related information is handled in accordance with our Privacy Policy, specifically Section 8 ("Text Messaging Communications").
We may modify our SMS program — including frequency, content types, and operational details — from time to time. Material changes will be communicated to subscribed users via SMS where appropriate. Continued participation after notice of changes constitutes acceptance.
We reserve the right to terminate the SMS program or any individual subscriber's participation at any time, without notice, for any reason including suspected abuse, fraud, technical issues, or for legal/regulatory reasons.
Our website, services, programs, and SMS communications are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service.
To the maximum extent permitted by Pennsylvania law, in no event shall Iron 24 PT, GZP Fitness LLC, or any of its officers, employees, agents, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, business interruption, or personal injury (except where such limitation is prohibited by law) arising out of or related to your use of our services, website, or SMS program.
Our total aggregate liability for any claim arising under or related to these Terms shall not exceed the greater of (a) the total fees you paid to Iron 24 PT in the 12 months preceding the claim, or (b) $100 USD.
You agree to indemnify, defend, and hold harmless Iron 24 PT, GZP Fitness LLC, and its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of (a) your violation of these Terms, (b) your misuse of our services, (c) your violation of any third-party rights, or (d) any false or unauthorized information you provide.
Before pursuing formal dispute resolution, you agree to attempt to resolve any dispute by contacting us at info@iron24pa.com and providing a written description of the dispute. We will respond within 30 days.
Any dispute that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will be conducted in Pittsburgh, Pennsylvania, in English. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
You agree that any dispute will be resolved on an individual basis and not as part of a class, consolidated, or representative action. This waiver does not preclude individual TCPA, FCC, or state consumer protection claims to the extent prohibited by applicable law.
Notwithstanding the above, either party may bring an action in small claims court for disputes within that court's jurisdiction.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania.
We may update these Terms from time to time. The "Last Updated" date at the top of these Terms indicates the date of the most recent revision. Material changes will be communicated via email, SMS (where applicable), or prominent notice on our website. Your continued use of our services after such changes constitutes acceptance of the revised Terms.
We may suspend or terminate your access to our services, including SMS communications, at any time for violation of these Terms, suspected fraud, abuse, non-payment, or for any reason in our sole discretion. Sections 7, 8, 9, 10, 11, 12, and 14 survive termination.
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy and any Liability Waivers you have signed, constitute the entire agreement between you and Iron 24 PT.
